These Terms of Service govern your use of the Aircon Kits website and your purchase of products from Aircon Kits.
Aircon Kits is a division of Aircon Rescue Inc., doing business as Aircon Kits. Throughout these Terms, “Aircon Kits,” “we,” “us” and “our” refer to Aircon Rescue Inc. doing business as Aircon Kits. “You” and “customer” refer to any person or business using our website or purchasing our products.
By accessing our website, placing an order or using our products or resources, you agree to these Terms of Service together with our other published policies.
1. Use of Our Website
You may use the Aircon Kits website for lawful purposes and to obtain information about or purchase our products.
You agree not to use the website for unlawful or fraudulent purposes, to interfere with the operation or security of the website, to transmit malicious code or harmful material, to attempt unauthorized access to our systems or customer information, or to misuse Aircon Kits content, product information or other website materials.
We may restrict access to the website where reasonably necessary to protect our business, customers or systems.
2. Products
Aircon Kits supplies specialty components for custom portable-air-conditioner panel systems, including adapters, mounting products, replacement components and related accessories.
We make reasonable efforts to ensure product descriptions, photographs, dimensions and specifications are accurate. Minor manufacturing variations may occur, colours may appear differently depending on screens or photography, specifications may be updated as products evolve, and product availability may change without notice.
Where dimensions or fit are critical to fabrication, customers should verify the physical product before beginning a large production run.
3. Product Compatibility
Customers are responsible for confirming that a product is suitable for their intended application before ordering or fabrication, including relevant hose diameter, hose connection style, panel thickness, cutout dimensions, portable-AC configuration, mounting surface and compatibility with third-party components.
Aircon Kits provides compatibility information to assist customers but cannot guarantee compatibility with every portable-air-conditioner model, window configuration or third-party product.
Our Product Compatibility & Fabrication Resources Policy forms part of these Terms.
4. Orders
Submitting an order does not necessarily mean that Aircon Kits has accepted it.
We may cancel or decline an order where reasonably necessary, including because of inventory errors, pricing or listing errors, suspected fraud, payment problems, shipping restrictions, unusually large quantities requiring separate freight arrangements, or other circumstances that prevent us from reasonably fulfilling the order.
If we cancel an order after payment has been collected, the applicable amount will be refunded.
5. Order Information
Customers are responsible for providing accurate billing information, shipping information, contact information, product selections and quantities.
Please contact us promptly if an order needs to be changed. Once fulfillment has begun or an order has shipped, changes or cancellation may no longer be possible.
6. Pricing
Product prices may change from time to time without notice. The price charged will normally be the price displayed when the order is placed, subject to correction of obvious errors.
Taxes, shipping charges, duties and other applicable charges may be added during checkout where required.
Promotions and discounts may have eligibility requirements, may be changed or discontinued, may not necessarily be combined, and apply only during the stated promotional period.
7. Volume & Commercial Orders
Aircon Kits may offer volume pricing for qualifying larger orders. Volume discounts apply only to qualifying merchandise and may be subject to additional conditions shown on the website or during checkout.
Large commercial orders may require multiple packages, freight shipping, additional lead time or separate shipping arrangements.
Returns of volume, bulk or discounted commercial orders are subject to our Returns & Refunds Policy and are not automatically covered by the standard return provisions.
8. Shipping
Aircon Kits currently ships within Canada and the United States.
Shipping times are estimates and are not guaranteed. Carrier delays, customs processing, weather, remote destinations and other circumstances outside our control may affect delivery.
Customers are responsible for providing a complete and accurate shipping address. Our Shipping Policy forms part of these Terms and contains additional information regarding delivery times, tracking, customs, damage, lost shipments and freight.
9. U.S. Customs, Duties & Import Charges
Aircon Kits products are manufactured in China.
Orders shipped to the United States are declared using the appropriate country of origin and customs classification. Applicable duties and import taxes may be assessed according to U.S. regulations in effect when the order is processed.
Where available, Aircon Kits may collect estimated duties and import charges during checkout and ship using a Delivered Duties Paid service.
Customs authorities retain the ability to review or reassess a shipment, and Aircon Kits cannot guarantee that a customs authority will never impose an additional charge.
10. Returns & Refunds
Eligible standard purchases may generally be returned within 30 days of delivery subject to our Returns & Refunds Policy.
Products should normally be unused, uninstalled, in original packaging and in resalable condition.
Customer ordering or compatibility errors do not automatically make a product defective. Original shipping charges are normally non-refundable, and customers are generally responsible for normal return shipping.
11. Fabrication Resources
Certain eligible products may include access to production-ready cutout files or other fabrication information. These resources are provided to assist with the use of the corresponding Aircon Kits component.
Customers and fabricators remain responsible for confirming dimensions, selecting appropriate materials, verifying machine and cutting settings, testing fit and confirming the finished product is suitable for its intended application.
Aircon Kits is not responsible for wasted material, production losses or other fabrication costs resulting from incorrect measurements, cutting, settings, materials or use of an incompatible component.
Receiving fabrication files does not prevent an otherwise eligible physical product from being returned.
12. Hook-and-Loop Mounting Products
Performance of hook-and-loop mounting products can be affected by installation conditions, surface preparation, heat, moisture, storage conditions and normal wear.
Customers and fabricators are responsible for following applicable product information and using mounting materials on suitable surfaces.
Aircon Kits is not responsible for melting, discoloration, adhesive deterioration, loss of adhesion or similar deterioration caused by excessive heat, improper storage, unsuitable surfaces, improper installation, misuse or environmental conditions outside the intended application.
Normal wear and aging are not considered manufacturing defects.
13. Installation & Fabrication
Aircon Kits supplies components. Unless specifically stated otherwise, we do not provide professional installation, engineering, building-envelope, electrical or HVAC services.
Customers, installers and fabricators are responsible for determining whether their intended fabrication and installation methods are appropriate.
Aircon Kits is not responsible for damage resulting from improper measurement, fabrication, installation, modification, use, mounting or material selection.
14. Intellectual Property
The Aircon Kits website and its original content, including product photographs, graphics, branding, written material and other proprietary content, are owned by or licensed to Aircon Kits unless otherwise indicated.
You may not reproduce, republish, sell or commercially distribute our website content without permission except where permitted by law.
Technical files supplied with purchased products may be used as reasonably necessary to fabricate panels incorporating the applicable Aircon Kits component.
15. Third-Party Services
Our website may rely on third-party services, including Shopify, payment processors, shipping carriers, customs services, analytics providers and other ecommerce technology providers.
Those services may operate under their own terms and privacy policies. Aircon Kits is not responsible for outages, delays or failures caused solely by third-party services outside our reasonable control.
16. Third-Party Links
Our website may occasionally contain links to third-party websites or resources. These links are provided for convenience. Aircon Kits does not control third-party websites and is not responsible for their content, products, services, security or policies.
17. Product Use
Products must be used for their intended purpose and in accordance with the applicable product information.
Customers assume responsibility for ensuring that components are suitable for the intended application, installation is carried out appropriately, modifications do not create unsafe conditions, and products are used in accordance with applicable laws and building or safety requirements.
18. Disclaimer
We make reasonable efforts to provide accurate product information and reliable products.
However, to the extent permitted by applicable law, Aircon Kits does not guarantee that the website will always be uninterrupted or error-free, every product will be compatible with every third-party device, product information will meet every particular fabrication requirement, or delivery estimates will always be achieved.
Nothing in these Terms excludes any consumer rights that cannot legally be excluded.
19. Limitation of Liability
To the extent permitted by applicable law, Aircon Kits will not be liable for indirect, incidental, consequential or special losses arising from the purchase or use of our products or website.
This includes, where applicable, lost production time, lost profits, wasted panel material, fabrication costs, business interruption and damage resulting from improper installation or incompatible equipment.
Where liability cannot legally be excluded, it will be limited only to the extent permitted by applicable law.
20. Indemnification
To the extent permitted by law, you agree to be responsible for claims, losses or costs resulting from your unlawful use of our website or your improper modification, installation or use of Aircon Kits products.
This provision does not limit rights or remedies that cannot legally be waived.
21. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada.
Nothing in this section removes any mandatory consumer protections that may apply based on the customer's location.
22. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
23. Changes to These Terms
Aircon Kits may update these Terms from time to time. The current version will be posted on our website together with the date it was last updated.
Changes apply to future use of the website and future transactions from the effective date of the updated Terms.
